National Human Rights Commission

 


A demand was raised for international protection of basic human rights. This led to the formulation of the popular suggestion that the charter of the united Nations should include necessary provision for the protection of human rights, considering all human being same on the ground of humanity. It was agreed that The United Nations Organizations would, strive for international co-operation in promoting and encouraging respect for the human rights and also for the fundamental freedom of the people without discrimination on ground of race, language or religion. It is definitely a point of assertion on human consideration that upholds the dictum of equal rights of men.

    Our National Human Rights Commission (NHRC) came into being in October 1993 out of Indian's concern for the protection and promotion of human rights. At present, the former chief justice of India its chairman. NHRC has emerged as a permanent body which has vital instructive link with the Minorities Commission, the National Commission for women SCs and STs Commission. Its main function are: (i) to inquire, on its own initiative or on a petition presented to it by a victim or any person on his behalf; (ii) to intervene in any proceeding involving any allegation of violation of human rights pending before a court with the approval of such court; (iii) visit, under intimation the State Government, any jail or any Institution under the control of State Government, where persons are detained or lodged for purposes of treatment, reformation or protection to study the living conditions of the inmates and make recommendations thereon; (iv) review the safeguards provided by or under the constitution or any law (v) spread human rights literacy among various sections of society; (vi) review the factors including acts of terrorism.

    The commission has its own investigating staff for investigation into complaints of human rights violation. Under the Act, it is open to the commission to utilize the services of any officer or investigation agency of the Central Government or Any State Government. Ordinarily, complaints of the following nature are not centralized by the commission: (a) events after more than one year; (b) matters which are sub-judice; (c) which are vague; (d) which are of frivolous nature, (e) which pertain to service matters. Each country with the establishment of National Human Rights Commission should be vigilant in his regard and the international H.R.C should act as a guiding principal for them.
